These terms explain the rules for using Deployed Hearts. Please read them carefully — they include important information about medical disclaimers, payments, and your legal rights.
1. Acceptance of these terms
By creating an account, placing an order, booking a service, or otherwise using the Deployed Hearts website, mobile applications, or services (together, the “Services”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these terms.
2. Our services
Deployed Hearts is a program of the Black Heart Association, a 501(c)(3) nonprofit (“BHA,” “we,” “us”). Through the Services we offer:
- Mail-in blood test kits for self-collection at home;
- Home visits by a qualified healthcare worker to collect samples;
- Screening at community events hosted by churches, schools, employers, and others;
- A marketplace connecting organizations with independent healthcare workers; and
- An online portal to view results and manage orders and bookings.
Samples are processed by independent CLIA-certified laboratories. An independent licensed physician authorizes test orders and reviews results. Availability of specific tests and services may vary by state.
3. Not a substitute for medical care
If you think you are having a medical emergency, call 911 or go to the nearest emergency room immediately. Do not rely on the Services for emergency care.
The Services provide screening information only. Our tests are not intended to diagnose, treat, cure, or prevent any disease, and results should be discussed with your own physician or healthcare provider. Using the Services does not create a physician–patient relationship with BHA. Content on our website, blog, and app is for general educational purposes and is not medical advice.
4. Your account
You agree to provide accurate, current, and complete information, including your identity, contact details, and health information needed to process your test. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at info@blackheartassociation.org if you suspect unauthorized access.
You may only order tests for yourself, or for a person for whom you are a legal guardian or authorized representative.
5. Orders, payment, and refunds
Prices are shown at checkout in U.S. dollars. Payments are processed securely by our payment provider, Stripe; we do not store your full card number. By placing an order you authorize us to charge the payment method you provide, including recurring charges for annual packages until you cancel.
Cancellations and refunds
- Mail-in kits: you may cancel for a full refund before your kit ships. Once shipped, kits cannot be returned, but we will replace any kit that arrives damaged or defective.
- Home visits: you may cancel or reschedule at no charge up to 24 hours before your appointment. Late cancellations or missed appointments may be charged.
- Community events: cancellation terms are set out in your event booking confirmation.
- Unusable samples: if a laboratory cannot process your sample, we will offer one free recollection or a refund of the affected test.
Services are private-pay and are not billed to insurance. We may change prices at any time, but changes will not affect orders already placed.
6. Sample collection and results
You agree to follow all collection, fasting, and shipping instructions. Results may be delayed or unavailable if a sample is improperly collected, damaged, lost in transit, or received outside the laboratory’s stability window. Turnaround times are estimates, not guarantees.
If a result is in a critical range, we or the reviewing physician may contact you directly by phone, text, or email using the contact details on your account.
7. Healthcare workers and hiring organizations
Healthcare workers who join through Work With Us or the Deployed Hearts mobile app are independent contractors, not employees of BHA, unless a separate written agreement states otherwise. Workers must hold and maintain all licenses, certifications, insurance, and background checks required for the work they accept, and must keep their credentials current in the app.
When accepting a job, workers agree to use in-app check-in, GPS verification, and photo documentation as instructed, to follow applicable clinical, safety, and chain-of-custody procedures, and to protect all patient information they encounter.
Organizations that hire workers or book events agree to provide a safe, suitable location and accurate information about the event and expected attendance.
8. Text messages and emails
By providing your phone number, you consent to receive transactional text messages from Deployed Hearts about your orders, appointments, results, and account. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent to marketing messages is never a condition of purchase.
9. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or on behalf of someone without authority;
- Provide false identity or health information, or tamper with test kits or samples;
- Resell test kits or Services without our written permission;
- Attempt to access accounts or data that are not yours, or interfere with the security or operation of the Services;
- Scrape, reverse engineer, or copy the Services except as permitted by law.
We may suspend or terminate accounts that violate these terms.
10. Intellectual property
The Services, including all text, graphics, logos, and software, are owned by BHA or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Services for their intended personal purpose. Your own health data remains yours.
11. Disclaimers and limitation of liability
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, BHA disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. No test is 100% accurate, and results may include false positives or false negatives.
To the fullest extent permitted by law, BHA and its officers, directors, volunteers, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow these limitations, so they may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless BHA from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services or your violation of these terms or of any law or third-party right.
13. Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days.
14. Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you by email or through the Services before they take effect. Continuing to use the Services after changes take effect means you accept the updated terms.
